Welcome to Pristine Auto Protect. These Terms of Service ("Terms") govern your access to and use of our website, services, and any related communications. By using our website or submitting information through our forms, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
1. About Our Services
Pristine Auto Protect offers Vehicle Service Contracts (VSCs), commonly referred to as "extended auto warranties." A VSC is not an insurance policy and is not a manufacturer's warranty. A VSC is a contract between you and Pristine Auto Protect that provides coverage for the repair or replacement of certain mechanical components of your vehicle, subject to the specific terms, conditions, and exclusions outlined in your individual service contract.
2. Eligibility
To use our services and purchase a Vehicle Service Contract, you must be at least 18 years of age, be the legal owner or lessee of the vehicle being covered, and provide accurate and truthful information about yourself and your vehicle. Vehicles must meet our eligibility requirements regarding age, mileage, and condition at the time of enrollment. Pristine Auto Protect reserves the right to deny coverage for vehicles that do not meet eligibility criteria or that have pre-existing mechanical conditions.
3. Quotes and Pricing
All quotes provided through our website, by phone, or via email are estimates based on the vehicle and contact information you provide. Final pricing, coverage terms, and deductible options are confirmed upon enrollment and are detailed in your individual Vehicle Service Contract. Quotes are not binding offers and are subject to change based on verification of vehicle information. Pristine Auto Protect reserves the right to modify pricing at any time. Price changes will not affect existing contracts already in force.
4. Your Vehicle Service Contract
Your Vehicle Service Contract is a separate legal agreement that governs the specific terms of your coverage, including covered components, exclusions, deductible amounts, term length, mileage limits, cancellation terms, and claims procedures. These Terms of Service do not replace or override your individual Vehicle Service Contract. In the event of a conflict between these Terms and your Vehicle Service Contract, the Vehicle Service Contract shall control with respect to coverage-related matters.
5. Waiting Period
All Vehicle Service Contracts are subject to a waiting period of 30 days and 1,000 miles, whichever comes first, beginning on the date of purchase. No claims will be authorized for mechanical failures that occur during the waiting period. This is an industry-standard practice designed to ensure that coverage applies to new mechanical failures and not pre-existing conditions.
6. Claims Process
When a covered mechanical failure occurs, you must contact Pristine Auto Protect's claims department before any repair work begins. Take your vehicle to any licensed repair facility of your choice in the United States. The repair facility must contact Pristine Auto Protect to obtain authorization before performing repairs. Unauthorized repairs — meaning repairs performed without prior approval from Pristine Auto Protect — may not be eligible for reimbursement. Claims are subject to the terms, covered components, and exclusions outlined in your individual Vehicle Service Contract.
7. Cancellation and Refunds
You may cancel your Vehicle Service Contract at any time. If you cancel within 30 days of purchase and no claims have been filed, you will receive a full refund. If you cancel after 30 days, you will receive a prorated refund based on the remaining unused term of your contract, less any claims paid on your behalf and a reasonable administrative fee (not to exceed $50). Refund processing typically takes 10 to 15 business days. Pristine Auto Protect reserves the right to cancel your contract if you fail to make required payments, provide false or misleading information, or misuse your vehicle in a manner that violates the terms of coverage (such as racing, off-road use on non-off-road vehicles, or odometer tampering).
8. Website Use
You agree to use our website only for lawful purposes. You may not use our website to submit false or fraudulent information, attempt to gain unauthorized access to our systems or data, interfere with the proper functioning of the website, scrape, harvest, or collect data from our website without our express written consent, or use automated tools (bots, scripts, spiders) to access the website for any purpose.
9. Accuracy of Information
We make reasonable efforts to ensure the information on our website is accurate and up to date. However, we do not guarantee that all content — including coverage descriptions, plan details, component lists, pricing, testimonials, and statistics — is free from errors or omissions. Coverage details shown on the website are for general informational purposes only. Your individual Vehicle Service Contract is the sole binding document that defines your specific coverage terms and exclusions.
10. Intellectual Property
All content on this website — including but not limited to text, graphics, logos, icons, images, designs, page layout, and software — is the property of Pristine Auto Protect or its licensors and is protected by United States and international copyright, trademark, and intellectual property laws. You may not copy, reproduce, distribute, modify, display, or create derivative works from any content on our website without our prior written consent. The Pristine Auto Protect name, logo, and shield design are trademarks of Pristine Auto Protect. Unauthorized use of our trademarks is strictly prohibited.
11. Third-Party Links
Our website may contain links to third-party websites or services that are not owned or controlled by Pristine Auto Protect. We are not responsible for the content, accuracy, privacy practices, or availability of any third-party sites. Inclusion of a link does not imply endorsement. We encourage you to review the terms and privacy policies of any third-party sites you visit.
12. Communications Consent
By submitting your information through our website or by phone, you consent to receive communications from Pristine Auto Protect via phone calls (including automated or pre-recorded calls), text messages (SMS/MMS), and email regarding your quote request, policy information, claims updates, renewal reminders, and promotional offers. Consent to receive marketing communications is not a condition of purchasing a Vehicle Service Contract. You may opt out of marketing communications at any time by replying "STOP" to any text message, clicking "Unsubscribe" in any email, or contacting us directly. Standard message and data rates may apply.
13. Limitation of Liability
To the maximum extent permitted by applicable law, Pristine Auto Protect, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services, any errors or omissions in website content, any unauthorized access to or alteration of your personal information, or any interruption or cessation of our website or services. Our total liability for any claim arising from these Terms or your use of our website shall not exceed the amount you have paid to Pristine Auto Protect in the 12 months preceding the claim. This limitation does not apply to liability that cannot be excluded or limited under applicable law.
14. Disclaimer of Warranties
Our website and its content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Pristine Auto Protect does not warrant that the website will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
15. Indemnification
You agree to indemnify, defend, and hold harmless Pristine Auto Protect and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your use of our website or services, any information you submit through our website that is false, misleading, or fraudulent, or your violation of any applicable law or regulation.
16. Dispute Resolution
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of our website or services shall first be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within 30 days, either party may submit the dispute to binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules. Arbitration shall take place in the state where Pristine Auto Protect maintains its principal place of business, unless otherwise agreed by the parties. You agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class, consolidated, or representative action. Nothing in this section prevents either party from seeking injunctive or other equitable relief from a court of competent jurisdiction.
17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the state in which Pristine Auto Protect is incorporated, without regard to its conflict of law provisions. You consent to the personal jurisdiction of the state and federal courts located in that state for any actions not subject to arbitration.
18. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent of the parties.
19. Entire Agreement
These Terms, together with our Privacy Policy and your individual Vehicle Service Contract (if applicable), constitute the entire agreement between you and Pristine Auto Protect regarding your use of our website and services. These Terms supersede any prior agreements, communications, or understandings, whether written or oral, relating to the subject matter herein.
20. Changes to These Terms
Pristine Auto Protect reserves the right to modify or update these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page. Your continued use of our website after any changes constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
